No. 4-0902-A <br /> Documemt No. SM-41-5Olg <br /> <br /> AMENDMENT TO AGREEMENT <br /> <br />THIS AMENDMENT TO AGREEMENT, ENTERED INTO ON December 16, 1985, <br />is between the STATE OF CALIFORNIA, acting by amd through its De- <br />partment of Transportation, referred to herein as STATE, and <br /> <br /> CITY OF REDWOOD CITY <br /> a body politic and a municipal <br /> corporation of the State of <br /> California, referred to herein <br /> as CITY. <br /> <br /> RECITALS <br /> <br /> (1) The parties hereto entered into au agreement (Doc- <br />ument No. SM-41-5018) on February 13, 1984, said agreement de- <br />fining the terms and conditions of a cooperative project to <br />install a traffic control signal system and safety lighting and <br />channellzatton at the imtersection of Charter Street with State <br />Highway Route 82, referred to herein as the PROJECT. <br /> <br /> (2) It has been determined that the P~OJECT will mot <br />be constructed prior to the termination date of said-AGREEMENT. <br /> <br />IT IS MUTUALLY AGREED AS FOLLOWS: <br /> <br /> (1) That Section III, Article (~8) of the original <br />AGREEMENT is amended to read: "The terms of this agreement con- <br />cerning the construction of PROJECT shall terminate upon com- <br />pletion amd acceptance of PROJECT by STATE and upon final <br />accounting of costs, or on December 31, 1986, if a contract to <br /> <br /> <br />
