<br />matter hereof are superseded by this Lease. Except as otherwise provided herein, no <br />subsequent change or addition to this Lease shall be binding unless in writing and signed <br />by the parties hereto. <br /> <br />20.7 No Waiver By Landlord. To the extent permitted by applicable law, no failure <br />by Landlord to insist upon the strict performance of any term hereof or to exercise any right, <br />power or remedy consequent upon a default under this Lease, and no acceptance of rent <br />during the continuance of any such default, shall constitute a waiver of any such default or <br />of any such term. No waiver of any default shall affect or alter this Lease, which shall <br />continue in full force and effect, or the rights of Landlord with respect to any other then <br />existing or subsequent default. <br /> <br />20.8 Amendment. This Lease can be modified, supplemented, amended or <br />rescinded only by a writing expressly referring to this Lease and signed by Landlord and <br />Tenant. <br /> <br />20.9 Severability: Consent. If any term of this Lease or any application thereof <br />shall be invalid or unenforceable, the remainder of this Lease and any other application of <br />such term shall not be affected thereby. Unless otherwise expressly provided herein, any <br />approval or consent of Landlord required hereunder shall not be unreasonably withheld or <br />delayed. This Lease shall be binding upon and inure to the benefit of and be enforceable <br />by the respective successors of the parties hereto. The headings in and the table of <br />contents of this Lease are for purposes of reference only and shall not limit or define the <br />meaning hereof. This Lease may be executed in any number of counterparts, each of <br />which shall be an original, but all of which shall together constitute one and the same <br />instrument. <br /> <br />20.10 Holding Over - Consensual. In the event Tenant shall holdover or remain in <br />possession of the Premises with the written consent of Landlord after the expiration of the <br />Term of this Lease, such holding over or continued possession shall create a tenancy for <br />month to month only, upon the same terms and conditions as are herein set forth and in <br />effect the last month prior to the expiration of the Term of this Lease. <br /> <br />20.11 Holding Over - Non-Consensual. If Tenant remains in possession of the <br />Premises or any part thereof after the expiration of the Term of this Lease without the <br />express written consent of Landlord, such occupancy shall be a tenancy from month to <br />month at a monthly rental in twice the amount in effect the last month prior to the expiration <br />of the Term of this Lease, plus all other charges payable hereunder, and upon all the terms <br />hereof applicable to a month-to-month tenancy. <br /> <br />20 <br /> <br />"---""--""'" ..--.
