No. 4-0941-C <br />notice from STATE that the construction contract for the <br />IMPROVEMENTS has been advertised (which notice will be forwarded <br />immediately following the advertising), funds in the amount of <br />$137,000 in accordance with the terms and conditions of this <br />agreement. Said $137,000 represents SAN CARLOS' estimated share <br />of the construction cost required to complete the IMPROVEMENTS <br />as shown on EXHIBIT B. Actual cos~ to be borne by SAN CARLOS <br />will be determined upon completion of all work ~nd shall be 32.71 <br />percent of the total matching fund towRrds the construction cost <br />of said IMPROVEMENTS including STATE-furnished materials, if any, <br />and any extra or additional work directly related to the said <br />IMPROVEMENTS. In no event shall SAN CARLOS' total obligation <br />for construction costs including contract change orders (excluding <br />utility arrangement costs and protection, relocation and/or removal <br />costs, if any) under this agreement exceed the amount of $165,000 <br />provided khat SAN CARLOS may, at its sole discretion in writing, <br />authorize a greater amount. <br /> <br /> (2) To deposit with STATE within 20 days of receipt of <br />billing, additional funds upon request by STATE to finance contract <br />change orders, if any, subject to the limitation set forth in <br />Section IV, Article (1). STATE may defer implementation of <br />changes requiring supplemental deposits until after said deposits <br />are made by SAN CARLOS except when necessary for the safety of <br />motorists and pedestrians or protection of property. <br /> <br /> (3) To deposit with STATE, within 20 days of receipt of <br /> billing, the estimated cost of arranging for and protecting, <br /> <br /> --8-- <br /> <br /> <br />
