4. SPECIAL ORDERS — Proclamation — National Volunteer Month <br />Evan Low, representing the Volunteer Center of Silicon Valley received the <br />proclamation from Mayor Ira. He thanked Council and the community for its volunteer <br />efforts, inviting the community to participate in "The Human Race" on May 7. <br />5. ORAL COMMUNICATIONS AND CONSENT CALENDAR <br />M/S Howard /Hartnett to waive reading of the Consent Calendar except the <br />ordinances by title, adopt the resolutions and the ordinances, and approve other <br />items. Council Member Hartnett removed item 5.1.13. for separate discussion and <br />vote. The motion passed by a unanimously roll call vote by those present with <br />Council Member Foust absent. <br />5.1 Section — Motions <br />A. Amended and Restated Disposition and Development Agreement (DDA) for First <br />Community Housing (FCH) proposal for 58 -unit affordable housing project at El <br />Camino & Vera Avenue — Redevelopment Agency <br />Council Member Pierce stated that the Redevelopment Agency currently does <br />not have authority under Article 34 of the California Constitution which provides <br />that low rent housing projects will not be developed, constructed or acquired by <br />any State public body unless the voters of the city approves the project in an <br />election. The City will not be getting credit for the very low and low income units <br />that are being developed in this project. She stated her appreciation for all the <br />staff work on this project and her support of the DDA, but asked that staff return <br />with the pros, cons and other information about the potential for developing <br />authority under Article 34 by going to the voters on this topic. Mayor Ira agreed <br />that the topic is important and that the City Attorney would be bringing <br />information forward. <br />Recommendation: <br />It is recommended that the Redevelopment Agency Board ratify and approve the <br />Amended and Restated DDA.
