AMENDMENT TO AGREEMENT <br /> CDS GROUP #2105 <br /> <br /> AGREEMENT dated February 1, 1974, as amended, between CITY <br />OF REDWOOD CITY and CALIFORNIA DENTAL SERVICE is hereby further <br />amended, effective February 1, 1974, as follows: <br /> <br /> Appendix "E", the Retention Agreement, shall read as attached <br />hereto. <br /> <br /> Paragraph 7 of GENERAL AGREEMENTS is amended to read: <br /> <br /> 7. In the event that any payment due pursuant to paragraph <br />1 (b) of this Agreement is not paid when due, CDS may give written <br />notice that payment is due, and if such payment is not received <br />within 10 days after such notice, CDS may, at its option, <br />terminate all further benefits and be released from all further <br />obligations hereunder; provided, however, that CDS shall make <br />payment to dentists for dental services authorized by CDS prior <br />to termination and for dental services which were performed <br />without prior authorization by a dentist prior to the date <br />this Agreement terminated. In the event of termination as <br />provided in this paragraph, EMPLOYER shall remain liable to CDS <br />for the full amount of all dentists' statements paid or otherwise <br />discharged by CDS plus the amount specified in Appendix "E" <br />to compensate CDS for its administration of the dental program, <br />less amounts actually paid by EMPLOYER to CDS. <br /> <br /> DATED: July 1, 1974 <br /> <br /> <br />
