DES:mmg s6/08/89 (#40/026) <br /> <br />set forth, and the parties hereto agree as follows: <br /> <br /> 1. SERVICES; TASK ORDERS. Harris shall provide expert <br />professional construction contract claims consulting services <br />including, but not necessarily limited to, providing <br />comprehensive analysis of any and all contract claims pertaining <br />to the Project and rendering advice to City, to and through the <br />office of the City Attorney ("Counsel") in connection with <br />currently outstanding claims, additional claims or counter-claims <br />(including such claims as the City may assert), potential <br />litigation, or litigation, or other judicial or quasi-judicial <br />proceedings as have arisen or may arise out of the Project. <br />Harris agrees to furnish said services and to use its best <br />efforts to coordinate all activities so that the construction <br />claims and contractual disputes arising out of the Project will <br />be resolved in a manner consistent with the interests of the <br />City. <br /> <br /> Specific services shall be performed pursuant to Task <br />Orders which shall set forth the scope of services to be <br />performed, estimated time of completion, cost estimates and/or <br />limitations, and such other terms and conditions as to which the <br />parties may agree. The first such Task Order is attached hereto, <br />marked "Task Order No. 1", and is hereby approved. All other <br />Task Orders shall, subject to the cost limitation specified <br />hereinafter in Paragraph 3, be prepared by Harris and submitted <br />to the City Manager who, upon approval thereof, shall execute <br />said task orders for and on behalf of the City. <br /> <br /> <br />
