In addition to the foregoing, and in any event, <br />Heron Court shall submit to City no later than July 31, 1989, a <br />detailed financial statement and analysis setting forth the <br />foregoing information and further setting forth a review and <br />report of all of Heron Court's operational and financial <br /> <br />activities during the term hereof. Heron Court shall, on a <br />monthly basis, submit to City's Housing Coordinator a program <br />analysis and progress report documenting Heron Court's success in <br />meeting the goals set forth in Exhibit "A". The final report <br />shall be submitted no later than July 15, 1989. If Heron Court <br />fails to submit such monthly reports on a timely basis, or if <br />City determines that such reports as submitted are insufficient <br />to determine whether or not Heron Court is meeting said goals, <br />City may withhold funds until such satisfactory reports are <br />received. <br /> <br /> 6. TERMINATION. City or Heron Court may terminate this <br />Agreement without cause at any time during the term hereof by <br />giving the other party thirty (30) days written notice that such <br />party intends to terminate this Agreement. In the event of <br />termination by the City or by Heron Court, Heron Court shall <br />submit a final invoice for any unreimbursed expenditures already <br />incurred. For purposes of this paragraph, the term "incurred" <br />shall not mean "encumbered", and shall refer solely to the actual <br />performance of quantities of work by a contractor. Heron Court <br />shall provide City with a final report of services provided under <br />this contract within thirty (30) days from date of termination. <br /> <br /> 3 <br /> <br /> <br />
