<br />"bonus value" in the subject property, if any, machinery, fixtures and equipment in, on or related to the <br />subject property; (ii) any claim Fireside has made or could have made under the Relocation Law <br />(Government Code Section 7260, et seq.) by reason of the City's acquisition of the subject property; <br />(iii) any claim Fireside has made or could have made against the City in connection with the carrying <br />out of the public project in which the subject property is situated. <br /> <br />7. <br /> <br />Fireside represents, warrants and certifies under penalty of perjury that it has authority to enter into <br />and grant the settlement herein given, including, but not limited to, any and all releases and/or <br />quitclaim deeds, and that it owns the business conducted on the subject property and holds title to the <br />lease and the leasehold improvements, fixtures and equipment, and that no document has been signed <br />by or on behalf of Fireside for the purpose of creating any lien, encumbrance or security interest, or <br />assignment, transfer, or any relinquishment of its interest in any lease, machinery, fixtures and/or <br />equipment and lor leasehold improvements. <br /> <br />Fireside agrees to indemnify, defend and hold the City harmless against and with respect to all claims, <br />demands, losses, costs, expenses, obligations, liabilities, damages, recoveries and deficiencies, <br />including interest, penalties, engineering consultant and attorneys' fees of a civil nature only that City <br />shall incur or suffer which arise, result from or relate to any toxic, pollutant or contaminant existing in, <br />on or beneath the subject property or any improvement, or equipment on the subject property. <br /> <br />8. <br /> <br />9. <br /> <br />Any amendment of, or supplement to, any instruments must be in writing. <br /> <br />. -j IAJN WIT~S1LERE.
