D. :nt 9/10/87 (~34) <br /> <br />seem best to serve the interest of the City; and if it is decided <br />to increase the said number of working days, the City shall <br />further have the right to charge to the Contractor, and deduct <br />from the final payment for the work, all or any part, as the City <br />may deem proper, of the actual cost of engineering, inspection, <br />superintendence, and other overhead expenses of the City which <br />are directly chargeable to this agreement, except that the cost <br />of final surveys and the preparation of final estimates shall not <br />be included in such charges to be paid by Contractor. <br /> <br /> In the event Contractor, for any reason, shall fail to <br />perform the work herein specified, within the time herein <br />required, to the satisfaction of the Engineer, City may, in lieu <br />of any other of its rights authorized in this agreement or in the <br />Specifications for this work, deduct from payments or credits <br />Five Hundred Dollars ($500.00) per day as liquidated damages for <br />each calendar day beyond the date herein provided for the <br />completion of such work, that the work does not meet the satis- <br />faction of the Engineer. <br /> <br /> 6. Except as otherwise may be provided herein, Contractor <br />hereby expressly guarantees for one (1) full year from the date <br />of the final completion of the work under this agreement and <br />acceptance thereof by the City's City Council, to repair or <br />replace any part of the work performed hereunder which consti- <br />tutes a defect resulting from the use of inferior or defective <br />materials, equipment or workmanship.
