D. :nt 9/10/87 (~34) seem best to serve the interest of the City; and if it is decided to increase the said number of working days, the City shall further have the right to charge to the Contractor, and deduct from the final payment for the work, all or any part, as the City may deem proper, of the actual cost of engineering, inspection, superintendence, and other overhead expenses of the City which are directly chargeable to this agreement, except that the cost of final surveys and the preparation of final estimates shall not be included in such charges to be paid by Contractor. In the event Contractor, for any reason, shall fail to perform the work herein specified, within the time herein required, to the satisfaction of the Engineer, City may, in lieu of any other of its rights authorized in this agreement or in the Specifications for this work, deduct from payments or credits Five Hundred Dollars ($500.00) per day as liquidated damages for each calendar day beyond the date herein provided for the completion of such work, that the work does not meet the satis- faction of the Engineer. 6. Except as otherwise may be provided herein, Contractor hereby expressly guarantees for one (1) full year from the date of the final completion of the work under this agreement and acceptance thereof by the City's City Council, to repair or replace any part of the work performed hereunder which consti- tutes a defect resulting from the use of inferior or defective materials, equipment or workmanship.
