Consultant shall keep and maintain an <br />accurate record of costs incurred, and time expended relating to <br />all services to be compensated hereunder on the basis of costs to <br />Consultant, which records shall be available to City for review <br />thereof upon request therefor by City. <br /> <br /> 9. HOLD HARMLESS AND INSURANCE. Consultant shall hold <br />harmless, indemnify and defend the City of Redwood City, its <br />Council, boards, commissions, officers, employees and agents from <br />claims for liability, losses or damage arising out of <br />Consultant's willful misconduct or its negligent acts, errors or <br />omissions during performance of this Agreement. <br /> <br /> Consultant shall acquire and maintain worker's <br />compensation insurance coverage in accordance with statutory <br />requirements and shall acquire and maintain commercial general <br />liability coverage, business automobile liability insurance and <br />professional liability insurance coverage protecting City, its <br />Council, boards, commissions, officers, agents and employees in <br />connection with Consultant's services performed hereunder. The <br />commercial general liability insurance coverage shall include <br />contractual property damage (including loss of use thereof), and <br />personal injury (including death) coverage and shall be not less <br />than $500,000.00 for each occurrence and $500,000.00 in the <br />aggregate. The business automobile liability insurance shall be <br />of the "Code 1" type and shall be not less than $500,000.00 for <br />each person, $500,000.00 each occurrence for bodily injury <br />liability and $300,000.00 for each occurrence for property damage <br /> <br /> 4 <br /> <br /> <br />
