DAS:sh 5/29/86 <br /> <br /> It is further agreed that in case the work called for under <br />this Agreement is not completed in all its parts and requirements <br />within the number of working days specified, the City shall have <br />the right to increase the number of working days or not, as may <br />seem best to serve the interest of the City; and if it is decided <br />to increase the said number of working days, the City shall <br />further have the right to charge to the Contractor, and deduct <br />from the final payment for the work, all or any part, as the City <br />may deem proper, of the actual cost of engineering, inspection, <br />superintendance, and other overhead expenses of the City which <br />are directly chargeable to this Agreement, except that the cost <br />of final surveys and the preparation of final estimates shall not <br />be included in such charges to be paid by Contractor. <br /> <br /> In the event Contractor, for any reason, shall fail to <br />perform the work herein specified, within the time herein <br />required, to the satisfaction of the City Engineer of Redwood <br />City or his representative, the City may, in lieu of any other of <br />its rights authorized in this Agreement or in the Specifications <br />for this work, deduct from payments or credits due the Contractor <br />a sum calculated at the rate of Five Hundred and No/100 Dollars <br />($500.00) per day as liquidated damages for each calendar day <br />beyond the date herein provided for the completion of such work, <br />that the work does not meet the satisfaction of the said City <br />Engineer or his representative. <br /> <br /> 6. Except as otherwise may be provided herein, Contractor <br />hereby expressly guarantees for one (1) full year from the date <br />of the final completion of the work under this Agreement and <br />acceptance thereof by the City's City Council, to repair or <br />4 <br /> <br /> <br />
