of race, color, religion, sex, or national origin in all phases of <br /> employment during the performance of federally assisted <br /> construction contracts. <br /> viii . Housing and Urban Development Act of 1968, <br /> Section 3, which requires that, in the planning and carrying out of <br /> any project assisted under the Act, that to the greatest extent <br /> feasible, opportunities for training and employment be given to low <br /> and moderate income persons residing within the unit of local <br /> government in which the project is located, and that contracts for <br /> work in connection with the project be awarded to eligible business <br /> concerns which are located in, or owned in substantial part by <br /> persons residing in the same unit of local government as the <br /> proj ect . <br /> ix. Lead-Based Paint Poisoning Act, which prohibits <br /> the use of lead-based paint in residential structures constructed <br /> or rehabilitated with Federal assistance. Compliance with said Act <br /> is set forth in further detail in the Scope of Development . <br /> Section 3 . 02 . Responsibility of the Aaency. The <br /> responsibilities of the Agency under this Agreement with respect to <br /> the development of the Property shall consist of the following: <br /> a. The Agency shall, subject to the terms of this <br /> Agreement, and specifically subject to, without limitation, the <br /> provisions of Section 2 . 02 hereof, convey the Property at no cost <br /> to the Developer. <br /> b. In addition, in accordance with Section 2 . 02 above, <br /> the Agency shall provide further assistance to the Developer for <br /> the development and construction of the Proj ect in the form of the <br /> Development Grant and the Fee Subsidy. The Agency shall have no <br /> obligation to disburse or to permit disbursal of any portion of the <br /> Development Grant or Fee Subsidy if (i) the Developer is in default <br /> of this Agreement or any agreement executed in connection herewith, <br /> or (ii) the Agency in the exercise of its reasonable discretion <br /> determines that the completion of the Project will not occur. The <br /> Agency reserves the right, in its sole discretion, to cause <br /> payments to be made directly to the third party providers of <br /> services, materials or labor. <br /> c . The Agency will perform such other work or <br /> obligations as is, if any, set forth in the Scope of Development . <br /> d. The Developer hereby grants to the Agency a license <br /> to enter upon any of the Property which has been conveyed to the <br /> REDW\0006\DOC\013-7 <br /> 2� 1\11\08 940 law <br />
