Housing and Urban Development Act of 1968, Section 3, which requires that, in the planning and carrying out of any project assisted under the Act, that to the greatest extent feasible, opportunities for training and employment be given to low and moderate income persons residing within the unit of local government in which the project is located, and that contracts for work in connection with the project be awarded to eligible business concerns which are located in, or owned in substantial part by persons residing in the same unit of local government as the proj ect . ix. Lead-Based Paint Poisoning Act, which prohibits the use of lead-based paint in residential structures constructed or rehabilitated with Federal assistance. Compliance with said Act is set forth in further detail in the Scope of Development . Section 3 . 02 . Responsibility of the Aaency. The responsibilities of the Agency under this Agreement with respect to the development of the Property shall consist of the following: a. The Agency shall, subject to the terms of this Agreement, and specifically subject to, without limitation, the provisions of Section 2 . 02 hereof, convey the Property at no cost to the Developer. b. In addition, in accordance with Section 2 . 02 above, the Agency shall provide further assistance to the Developer for the development and construction of the Proj ect in the form of the Development Grant and the Fee Subsidy. The Agency shall have no obligation to disburse or to permit disbursal of any portion of the Development Grant or Fee Subsidy if (i) the Developer is in default of this Agreement or any agreement executed in connection herewith, or (ii) the Agency in the exercise of its reasonable discretion determines that the completion of the Project will not occur. The Agency reserves the right, in its sole discretion, to cause payments to be made directly to the third party providers of services, materials or labor. c . The Agency will perform such other work or obligations as is, if any, set forth in the Scope of Development . d.
