Joint ~iciDatio[LWith- Other UtUities <br /> <br />(a) To the extent it is practicable to do so, RCN shall cooperate with all <br /> <br />other permittees, utilities, and permit applicants in the planning, location, and <br /> <br />construction of their joint and several telecommunications facilities within the <br /> <br />Public Right-of-Way. Upon completion of the work of improvement under each <br /> <br />Encroachment Permit, RCN shall, within thirty (30) days of receipt of the demand <br /> <br />of the City Engineer, deliver to the City Engineer such maps, plans, and diagrams <br /> <br />as may be required to show, in detail, the exact location, size, depth, and <br /> <br />description of the Facilities within the Public Right-of-Way in relation to all other <br /> <br />permittee telecommunication facilities. The delivery of these maps, plans, and <br /> <br />diagrams to City shall not relieve any third party of any legal or regulatory <br /> <br />requirements with respect to location of facilities in the Right-of-way and shall not <br /> <br />be deemed to impose any responsibility or duty (other than the responsibility or <br /> <br />duty, if any, imposed by Laws) with respect to any third party. Upon request of <br /> <br />the City, RCN shall pothole its subsurface Facilities, at its sole cost and expense, <br /> <br />with respect to any existing City underground utilities, telecommunication, or other <br /> <br />City facilities. <br /> <br />(b) In accordance with the provisions of Chapter 3.1 of Division 5 of Title 1 <br /> <br />of the Government Code of the State of California (~ 4216, et seq.), RCN, as an <br /> <br />operator of a subsurface installation, shall obtain and maintain membership in a <br /> <br />regional notification center (e.g., Underground Service Alert - Northern California), <br />Agmt-245 <br />G\shared\shared\Redwood\Coun e it <br />FXS/fs <br />03/15/99 <br />04/05/99; 04/20/99 <br />20 <br /> <br />
