<br />general liability, course of construction ("all risks") <br /> <br />and automobile liability <br /> <br />insurance coverage. original endorsements: <br /> <br />i) <br /> <br />Precluding cancellation or reduction in coverage before the <br />expiration of thirty (30) days after City shall have received written <br />notification of cancellation or reduction in coverage by first class <br />mail, postage prepaid; <br /> <br />Providing that Contractor's insurance shall apply separately to each <br />insured against whom claim is made or suit is brought, except with <br />respect to the limits of the insurer's liability (cross liability <br />endorsements); <br /> <br />ii) <br /> <br />iii) <br /> <br />Naming City, its Council, commissions. boards, committees, <br />officers. employees and agents as additional insureds; and <br /> <br />Providing that Contractor's insurance shall be primary insurance <br />relating to Contractor's work hereunder with respect to City. its <br />Council, commissions. boards. committees, officers. employees <br />and Agents, and further providing that any insurance or self- <br />insurance maintained by City for itself, its Council, commissions. <br />boards, committees, officers, employees and agents shall not be <br />excess of Contractor's insurance and shall not be contributory with <br />it. <br /> <br />Prior to commencement of the work of Reconstruction, Contractor <br /> <br />iv) <br /> <br />(f) <br /> <br />shall furnish to City a payment bond issued by a good and sufficient corporate <br /> <br />surety in the amount of the estimated cost of the work of Reconstruction, which <br /> <br />bond shall conform strictly to the provisions of Chapter 7, Title 15, Part 4, <br /> <br />Division 3, of the California Civil Code. <br /> <br />(g) <br /> <br />Contractor hereby agrees to defend, indemnify, and save harmless, <br /> <br />City, its Council, boards, commissions, officers, employees, and agents <br /> <br />(collectively, "Indemnitees") from and against any and all claims, suits, actions, <br /> <br />liability, losses, damages, expenses, costs (including, without limitation, costs <br /> <br />and fees of litigation) of every nature, kind, and description, which may be <br /> <br />Agmt-194 <br />f\sh\sh\RC\Council <br />DES:rg <br />09/09/98; 02/08/99R; 03/01/99R <br /> <br />6 <br /> <br />.,. ,.-..".".",.
