<br />SAN MATEO OPERATIONAL AREA <br /> <br />JPA REVISION <br /> <br />financial commitment under an adopted budget will lose <br /> <br />its voting status and such other privileges of membership <br /> <br />as the Area Emergency Services council shall determine. <br /> <br />7. <br /> <br />It is further agreed that any excess in federal or state <br />funds in any year shall be credited to the following <br /> <br />year's budget, and any deficit added to the following <br /> <br />year's budget. <br /> <br />I. <br /> <br />INSURANCB <br /> <br />1. <br /> <br />The County shall add the Emergency Services Organization <br /> <br />to its existing excess liability insurance coverage and <br /> <br />shall maintain such coverage in full force and effect <br /> <br />during the life of the Agreement. <br /> <br />Said excess liability <br /> <br />insurance coverage has a $250,000 self-insured retention <br /> <br />by the County. <br /> <br />Unless the Area Emergency Services <br /> <br />Council decides otherwise, County shall provide for the <br /> <br />defense of any claims or litigation within the $250,000 <br /> <br />self-insured retention. <br /> <br />Legal representation by the <br /> <br />County will ordinarily be provided by the county Counsel. <br /> <br />2. <br /> <br />Any out-of-pocket expense or loss, by way of judgment or <br /> <br />settlement, <br /> <br />arising <br /> <br />out <br /> <br />of <br /> <br />the <br /> <br />operation <br /> <br />of <br /> <br />this <br /> <br />Agreement, within the limits of the county's $250,000 <br />self-insured retention shall be shared by the parties in <br /> <br />accordance with the formula set forth in Paragraph G. <br /> <br />15 <br /> <br />SAN MATEO AREA OES <br /> <br />3 APRIL 97 <br />
