<br />DES:djk~7/07/98 <br /> <br />(013/70) <br /> <br />ORIGINAL <br /> <br />A G R E E MEN T <br /> <br />--------- <br /> <br />for <br /> <br />IMPROVEMENT OF CALIFORNIA ~~RINA <br /> <br />+¡./ <br />/$- day of <br /> <br />THIS <br /> <br />AGREEMENT, <br /> <br />made <br /> <br />and entered <br /> <br />into this <br /> <br />~A~ , 1998, by and between the CITY OF REDWOOD CITY, a <br /> <br />municipal corporation of the State of California, ( "City"), and <br /> <br />KAUFMAN AND BROAD - SOUTH BAY, <br /> <br />INC., <br /> <br />a California corporation, <br /> <br />("Owner") ; <br /> <br />WIT N E SSE T H : <br /> <br />WHEREAS, <br /> <br />Owner <br /> <br />is <br /> <br />engaged <br /> <br />in <br /> <br />subdividing <br /> <br />and <br /> <br />developing <br /> <br /> <br />certain property under the designation of Final Map of California <br />I/p¿ /2# ¡J,&' ,MAPS AT "t>/?~"'.I' f?.1,." /47 <br />Marina / situated in the City of Redwood City, County of San <br /> <br />Mateo, State of California; and <br /> <br />WHEREAS, the City Engineer has determined that the final map <br /> <br />conforms to the tentative map for the proposed subdivision; and <br /> <br />WHEREAS, Owner has requested that the final map be approved <br /> <br />prior <br /> <br />to <br /> <br />the <br /> <br />construction <br /> <br />and <br /> <br />completion <br /> <br />of <br /> <br />the <br /> <br />public <br /> <br />improvements, including all public utility facilities which are a <br /> <br />part of, or appurtenant to, the abovementioned subdivision, which <br /> <br />improvements are to be constructed in accordance with, <br /> <br />and as <br /> <br />required by, <br /> <br />the plans, <br /> <br />specifications and details hereinafter <br /> <br />described; and <br /> <br />WHEREAS, <br /> <br />as <br /> <br />of <br /> <br />the <br /> <br />date <br /> <br />of <br /> <br />approval <br /> <br />of <br /> <br />this <br /> <br />Agreement, <br /> <br />additional engineering information and estimates are necessary to <br /> <br />determine Owner's <br /> <br />contribution of the cost of constructing an <br />
