<br />NEC <br /> <br />21. <br /> <br />COSTS <br /> <br />Customer will pay all of NEC's costs or expenses, including reasonable attorney's and collection fees, incurred in enforcing <br />this Agreement. <br /> <br />22. <br /> <br />PRIOR AGREEMENTS <br /> <br />This Agreement supersedes all prior or contemporaneous proposals, communications and negotiations, both oral and written, <br />and constitutes the entire Agreement between NEC and Customer with respect to the purchase of the System. Any <br />representations, warranties or statements made by an employee, salesperson or agent of NEC and not expressed in the <br />Agreement are not binding upon NEC. <br /> <br />23. <br /> <br />SEVERABILITY <br /> <br />If any court holds any portion of this Agreement unenforceable, the remaining language shall not be affected unless the <br />failure to give effect to that portion will result in material loss or damage to the party for whose benefit such clause was <br />intended. <br /> <br />24. <br /> <br />AMENDMENTS AND MODIFICATIONS <br /> <br />Any modification of this Agreement must be in writing and executed by an authorized representative of the party against <br />whom enforcement is sought. <br /> <br />WHEREFORE, Customer and NEC have entered into this Agreement, as indicated by the signatures of their authorized <br />representatives below. <br /> <br /> <br />NEC BNS. ~ -f :5. ~::~ <br />By: ~ c.
