JAH:dit 1/15/91 (006/45) <br />)� AL '19/91R <br />AGREEMENT COVERING BIOREMEDIATION PLANS <br />FOR SEQUOIA STATION PROJECT SITE <br />A THIS AGREEMENT is entered into as of the day of <br />\J✓t� , 1991, by and between the REDEVELOPMENT AGENCY OF THE <br />CITY OF REDWOOD CITY, California ("Agency"), CYTOCULTURE <br />INTERNATIONAL, INC., a California corporation ("Consultant"), and <br />SEQUOIA STATION DEVELOPERS, INC., a California Corporation <br />("Developer"). <br />WHEREAS, the Sequoia Station Project will be constructed by <br />the Developer pursuant to its Disposition and Development <br />Agreement (the "DDA") with the Agency on approximately ten acres <br />of the site bounded by E1 Camino Real, James Avenue, the Southern <br />Pacific Railroad right of way and Jefferson Avenue (the "Site"); <br />and <br />WHEREAS, under the DDA the Developer has the sole <br />responsibility for determining whether toxic or hazardous <br />materials exist on the Site, and for treating and/or removing <br />such materials as may be found on the Site; and <br />WHEREAS, the Developer caused an analysis of the soils and <br />groundwater on the Site to be conducted which revealed that <br />portions thereof are contaminated by certain hazardous materials; <br />and <br />WHEREAS, to avoid the costly removal of large volumes of the <br />contaminated soil, a process itself fraught with undesirable <br />environmental consequences, a program has been devised to reduce <br />the level of contamination on the Site to an environmentally <br />acceptable level by the process of bioremediation, and then to <br />TRIPLkALTE <br />
