6.3.13. - Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />October 23, 2017 <br />SUBJECT <br />Authorize the City Attorney to Delegate Authority to Administer and Manage Claims and <br />Actions <br />RECOMMENDATION <br />Adopt a Resolution of the City Council of the City of Redwood City Amending <br />Resolution No. 15081 to Authorize the City Attorney to Delegate Authority to Administer <br />and Manage Claims and Actions against the City of Redwood City or its Officers or <br />Employees and Claims and Actions of the City of Redwood City <br />BACKGROUND <br />Under Government Code section 935.4, the Council may adopt a resolution authorizing <br />staff to resolve claims in an amount not to exceed $50,000. On January 24, 2011, <br />Council adopted Resolution No.15081. Resolution No.15081 authorizes the City <br />Attorney to resolve claims, potential claims, and actions against the City, its officers, or <br />employees and claims and actions by the City against others in an amount not to <br />exceed $25,000. Further, Resolution No.15081 authorizes the City Manager or <br />designee to resolve claims, potential claims, and actions against the City, its officers, or <br />employees and claims and actions by the City against others in an amount not to <br />exceed $50,000, when the City Attorney concurs in writing. <br />ANALYSIS <br />Resolution No.15081 is silent on whether the City Attorney may delegate authority to <br />administer and manage claims. The proposed resolution would provide the City <br />Attorney with the delegation authority that the City Manager already has. Authorizing <br />the City Attorney to delegate authority to resolve claims, potential claims, and actions <br />against the City, its officers, or employees and claims and actions by the City against <br />others in an amount not to exceed $25,000 would promote efficient and prompt handling <br />of claims, potential claims, and actions. <br />ALTERNATIVES <br />1. Council could take no action and current authority would remain in effect. <br />2. Council could authorize the City Attorney's designee to resolve claims and <br />actions in a different amount. <br />
