<br />DRAFT District AgrE' ent No. 4-1752-C <br /> <br />after <br /> <br />shall <br /> <br />refund to CITY promptly after completion of STATE's <br /> <br />final accounting of PROJECT costs, any amount of <br /> <br />CITY's <br /> <br />deposit <br /> <br />required <br /> <br />in Section II, Article (1) remaining after actual costs <br /> <br />to <br /> <br />be <br /> <br />borne by CITY have been deducted, or to bill CITY for any <br /> <br />additional amount required to <br /> <br />complete <br /> <br />CITY's <br /> <br />financial <br /> <br />obli- <br /> <br />gations pursuant to this Agreement. <br /> <br />(5 ) <br /> <br />To <br /> <br />submit <br /> <br />a final report of expenditures to CITY <br /> <br />within one hundred twenty (120) days after completion and accept- <br /> <br />ance of the construction contract for PROJECT by STATE. <br /> <br />(6) To maintain and operate the entire traffic <br /> <br />control <br /> <br />signal(s) <br /> <br />and <br /> <br />safety <br /> <br />lighting <br /> <br />as <br /> <br />installed and pay an amount <br /> <br />equal to 67% of the total maintenance and <br /> <br />operation <br /> <br />costs, <br /> <br />In- <br /> <br />cluding electrical energy costs. <br /> <br />(7) To furnish the traffic signal control equipment for <br /> <br />PROJECT. <br /> <br />This equipment shall consist of signal controller unit <br /> <br />and <br /> <br />signal <br /> <br />control <br /> <br />cabinet. <br /> <br />The <br /> <br />estimated <br /> <br />cost <br /> <br />of <br /> <br />this <br /> <br />STATE-furnished <br /> <br />equipment <br /> <br />is <br /> <br />$10,000, <br /> <br />and <br /> <br />the actual cost to <br /> <br />STATE shall be deducted from STATE's share of the PROJECT costs. <br /> <br />SECTION II <br /> <br />CITY AGREES: <br /> <br />( 1 ) <br /> <br />To deposit with STATE within 25 days of receipt of <br /> <br />billing therefor (which billing will be forwarded 15 <br /> <br />days <br /> <br />prlor <br /> <br />to <br /> <br />STATE's <br /> <br />bid <br /> <br />advertising date of a construction contract for <br /> <br />PROJECT), the amount of $63,000, which figure <br /> <br />represents <br /> <br />CITY's <br /> <br />-3- <br /> <br />,,«-<,-,-,-,,<-----'-<'<'-"'-----'--~- <br /> <br />,. <br />
