<br />(4) <br /> <br />~essional Liabilitv Insurance. <br /> <br />Professional liability insurance covering Contractor for any and <br /> <br />all errors or omissions committed by Contractor, its subcontractors, agents or employees, in <br /> <br />the performance of this Agreement. The policy, or policies, shall have limits of liability of not <br /> <br />less than $1,000,000 per occurrence. <br /> <br />(b) <br /> <br />Certificate of Insurance. <br /> <br />Prior to commencing work, Contractor shall fIle a Certificate(s) of <br /> <br />Insurance with the City evidencing coverage required by this Agreement, and upon request, a <br /> <br />certified duplicate original of the policy shall be submitted. City shall deliver said <br /> <br />Certificate(s) of Insurance, and upon request, a certified duplicate original of the policy, to <br /> <br />Authority for approval before the notice to proceed is issued. Said Certificate(s) shall <br /> <br />stipulate: <br /> <br />(1) <br /> <br />The insurance company(ies) issuing such policy(ies) shall <br /> <br />give written notice to City of any material alteration, or reduction in aggregate limits, if such <br /> <br />limits apply, and provide at least thirty (30) days' notice of cancellation. <br /> <br />(2) <br /> <br />That the policy(ies) is Primary Insurance and the <br /> <br />insurance company(ies) providing such policy(ies) shall be liable thereunder for the full amount <br /> <br />of any loss or claim which Contractor is liable for under the Section, up to and including the <br /> <br />total limit of liability, without right of contribution from any other insurance effected or which <br /> <br />may be effected by any Additional Insured. <br /> <br />-8- <br /> <br />631214.2 <br />
