<br />13. <br /> <br />COVENANT AGAINST CONTINGENT FEES. Consultant hereby <br /> <br />warrants that Consultant has not employed or retained any company or person, <br /> <br />other than a bona fide employee working for Consultant, to solicit or secure this <br /> <br />Agreement, and Consultant has not paid or agreed to pay any company or <br /> <br />person, other than a bona fide employee, any fee, commission, percentage, <br /> <br />brokerage fee, gift, or any other consideration contingent upon or resulting from <br /> <br />the award or formation of this Agreement. <br /> <br />For breach or violation of this <br /> <br />warranty, City shall have the right to annul this Agreement without liability, or at <br /> <br />City's discretion, to deduct from the Agreement price or consideration, or <br /> <br />otherwise recover, the full amount of such fee, commission, percentage, <br /> <br />brokerage fee, gift or contingent fee. <br /> <br />14. YEAR 2000 COMPLIANCE. <br /> <br />Nothing in this contract/agreement <br /> <br />represents or guarantees in any manner that City is, or will be, protected against <br /> <br />issues arising from Year 2000 compliance, or lack of, attributed to computer <br /> <br />systems, hardware, software, documentation, or processes. <br /> <br />15. DELAYS. The Consultant shall not be held liable for delays in the <br /> <br />Project caused by City's failure to perform its obligations in a timely manner. A <br /> <br />Project Schedule shall be agreed upon by City and the Consultants. In the event <br /> <br />that the Project Schedule is delayed more than 30 days, through no substantive <br /> <br />fault of the Consultant, Consultant shall have the right to request a review of the <br /> <br />Project Schedule and the scope of services under this Agreement.
