Where Federal wage determinations do <br />not contain the State wage rate determination otherwise available for use by Contractor <br /> <br />and its subcontractors, Contractor and its subcontractors shall pay not less than the <br />Federal minimum wage rate which most closely approximates the duties of the <br /> <br />employees in question. <br /> <br />(1 ) <br /> <br />Contractor shall also comply with the provisions of 29 CFR 5a.3 and all <br /> <br />amendments thereto, relating to Labor Standards for ratios of apprentices and trainees <br /> <br />to journeypersons. <br /> <br />(m) <br /> <br />Contractor and each subcontractor shall furnish to City within seven day <br /> <br />after the regular payment date of the weekly payroll period, a statement with respect to <br /> <br />wages paid to each of No. CA and General Wage Decision Modifications Nos. <br />through and/or general wage determinations applicable to this work published in the <br /> <br />Federal Register pursuant to 29 CFR, Subtitle A, Part 1, Section 1.5(b); as well as all <br />other requirements of the Davis-Bacon Act. Copies of said General Wage Decision and <br /> <br />said Federal Register pages are included herewith. <br /> <br />(n) <br /> <br />If there is a difference between the minimum wage rates predetermined <br /> <br />by the Secretary of Labor and the general prevailing wage rates determined by <br />the Director of- the California Department of Industrial Relations for similar <br /> <br />classifications of labor, Contractor and its subcontractors shall pay not less than the <br />higher wage rate. City will not accept lower State wage rates not specifically included in <br /> <br />the Federal minimum wage determinations. <br /> <br />This includes "helper" <br /> <br />(or other <br /> <br />classifications based on hours of experience) or any other classification not appearing in <br />the Federal wage determinations. Where Federal wage determinations do not contain <br /> <br />the State wage rate determination otherwise available for use by Contractor and its <br />subcontractors, Contractor and its subcontractors shall pay not less than the Federal <br /> <br />7 <br /> <br />.- ... <br />
