signals or tiaffic control devices. Language prohibiting such signage was incorporated/`"-
in the recommendation by the Planning Commission to the City Council. Due to an
editing error in Section 3.114.b, the ordinance adopted by the City Council reads as
permissive for signs in these locations. The•attached ordinance revisions correct the
error and reinstates language to make such signage illegaL
Other amendments to Section 3.114 provide clarity in the ordinance, and thus to
enforcement staff, regarding placement of signs in the public right-of-way. These
changes more clearly define the visibility triangle and the parking strip.
3) Next Steps
In June, the City Council sent back to the Architectural Review Committee and the
Planning Commission, two issues for reconsideration. They were asked to: a) review
the proposed Freeway Overlay Zone for possible expansion to the length of Hwy 101
within the City limits, and b) develop alternative language for exceptions to Prohibited
Signs, particularly animated signs. The Architectural Review Committee has completed
their work. The Planning Commission will take up the issue, pending a property owners
request to meet with the City Attomey. (The property owner has delayed this meeting,
and it is currently scheduled for December 9, 1999). Once the Planning Commission
considers the issues, recommendations will be brought back to the City Council as a
separate item after the first of the year. -
Additional amendments may also be necessary to assist enforcement of the City
Council intent regarding the sign ordinance. These would also be brought back to the
City Council after the first of the year.
Alternative
Do not adopt these amendments at this time and wait for the comprehensive revision in _
January. This alternative would delay effective implementation of the ordinance.
Fiscal Impact
The fiscal impact of approving these amendments is related to staff time in Code
Enforcement to implement the sign ordinance. There is no additional cost to the City.
J 5.(
Deborah Nelson d Everett
Community Development City Manager
Director
Attachment
Ordinance
__ ,_ ._.___.
