'3. <br />" - <br /> <br />This communication will serve as the requisite opinion of Counsel in connection <br />with the application of the City of Redwood City for funding made available <br />pursuantto 23 U.S.C. Section 133 and 23 U.S.C. Section 149. <br /> <br />1. The City of Redwood City is an eligible sponsor of projects for STP/CMAQ <br />funding. <br /> <br />2. The City of Redwood City is authorized to submit an application for <br />STP/CMAQ funding for the Construction of Rubberized Railroad <br />Crossings in he Cities of Burlingame and San Mateo. These crossings <br />include Broadway, Howard Avenue, Oak Grove, Peninsula Avenue (City <br />of Burlingame), and 25th Avenue (City of San Mateo). <br /> <br />3. I have reviewed the pertinent state laws and I am of the opinion that there <br />is no legal impediment to the City of Redwood City making applications for <br />STP/CMAQ funds. Furthermore, as a result of my examinations,.1 find <br />that there is no pending or threatened litigation, which might in any way <br />adversely affect the proposed projects, or the ability of the City of <br />Redwood City to carry out such projects. <br /> <br />Very truly yours, <br /> <br /> <br />David E.
