<br />Sß -I <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />February 7, 2000 <br /> <br />Subject <br />270 Lincoln Avenue <br /> <br />Recommendation <br />Uphold the decision of the Zonin9- Administrator to deny the variance, and thereby require <br />the removal of the patio enclosures. <br /> <br />Background <br />On April 27, 1999, Code Enforcement received a complaint about some illegal additions built <br />at 270 Lincoln Avenue (at the corner of Clinton and Lincoln Avenue). The owner of the <br />property had illegally enclosed two patio areas along the Clinton frontage, thereby creating <br />additional living space for an apartment building. <br /> <br /> <br /> <br />~ <br /> <br />The applicant essentially constructed walls within the existing patio fences, and attached a <br />sloped roof to the main building. The applicant is now using the living space to work on arts <br />and crafts. <br /> <br />The room addition violates the Zoning Ordinance in several ways. First, the room addition <br />comes to within about 2 Y2 feet of the property line along Clinton Avenue. Please refer to the <br />. attached site plan. The Zoning Ordinance requires that this set back be 15 ft. from the <br />property line. Also the room addition did not receive any design review by Planning & <br />Redevelopment staff, nor were any building permits issued. <br /> <br />Zoning Administrator Action <br />The applicant applied for a Variance to retain the existing addition. A variance is an <br />exception to the rule that can be granted only if a) special circumstances exist on the <br /> <br />- - <br /> <br />.~..---- .---...r <br />
