Special circumstances do not exist on the property that would warrant a variance from <br />the front yard setback requirement. The property is a typical shape and size for an <br />apartment complex and was originally approved with private open space in the front <br />yard setback area (Section 32.9 Open Space Requirements). The proposed enclosure <br />would displace the open space. <br /> <br />2. The granting of the variance would constitute a grant of special privilege, as the City has <br />. not permitted other variances for additions with six inch front yard setbacks on <br />properties with similar circumstances. By approving this variance, the City would be <br />setting a precedent for other development to be allowed in front yards. <br /> <br />3. The proposed six inch front yard setback from the public right of way where a 15' front <br />setback is required is contrary to the intent of the Zoning Ordinance to protect the <br />general welfare of the people of Redwood City.
