<br />Lt It lG <br /> <br />The Planning Commission's proposal is that the applicant would be required to notify property <br />owners within lOO ft. A Zoning Administrator's hearing would be required at the request of any <br />neighbor. However, the State Health and Safety Code says that neighbors objections are not <br />enough to justify denying a permit where other conditions have been met. Basically, we will be <br />creating a system that invites people to complain so that we can tell them it is not in our control. <br /> <br />Alternative Recommendation: <br />Since the majority view expressed by Planning Commissioners was that neighbors have a right to <br />know that a large family day care home is operating, an alternative notification process without <br />the conditional use permit requirements is recommended. A condition would be added to the <br />non-discretionary permit-that neighbors are notified of the approval and provided information <br />on the need for, and operation and regulation of family day care (see attached letter.) <br /> <br />'~"-"'-"'T . <br />
