<br />s-c.~ <br /> <br />4) City Retrieval and Impoundment of Abandoned Carts - Stray carts retrieved by the <br />City's retrieval service shall be delivered to the premises of participating businesses. <br /> <br />When stray carts are retrieved by the City's retrieval service, the owner who is not <br />participating in the citywide retrieval program will be notified within 24 hours and have <br />3 business days to pick up the cart(s) free of charge. After 3 days the owner will be <br />charged for retrieval, storage, and administrative costs, and shall be subject to <br />administrative penalties or prosecution punishable as an infraction. After 30 days, the <br />carts will be disposed of. <br /> <br />Pursuant to the Business and Professional Code Section 22435.7, any owner that fails <br />to retrieve its abandoned cart(s) picked up by the City after receiving the three-day <br />notice from the City shall pay the City's administrative costs for retrieving the cart(s), <br />storing the cart(s), and providing the notification to the owner. Any owner who fails to <br />retrieve abandoned carts in accordance with this Chapter in excess of three times in <br />a specified six-month period, shall be subject to a $50.00 fine for each occurrence. An <br />occurrence includes all carts owned by the Owner that are impounded by the City in <br />a one-day period. <br /> <br />"~---' '-'T - <br />
