<br />Jj) \\ <br /> <br />restriping of East Bayshore Road south of Whipple Avenue and the extension of <br /> <br />East Bayshore Road to Maple Street"; and <br /> <br />WHEREAS, as of the date of City's approval of this Agreement, City has <br /> <br />not adopted a Citywide or Areawide traffic impact fee program applicable to the <br /> <br />Project pursuant to Government Code Section 66000, et seq. (the "Mitigation <br /> <br />Fee Act"), nor has City established an assessment district or other financing <br /> <br />mechanism to fund the Emergency Access or other roadway improvements to <br /> <br />mitigate traffic impacts from existing, approved, and/or pending developments <br /> <br />along Bayshore Road and the Bair Island Area and vicinity thereof (collectively <br /> <br />referred to as the "Funding Programs"); and <br /> <br />WHEREAS, notwithstanding that City has not adopted such Funding <br /> <br />Programs and regardless of whether City has adopted such Funding Programs <br /> <br />or anyone of them prior to issuance of. the building permits required for the <br /> <br />construction of the Project, pursuant to the conditions of approval of the Planned <br /> <br />Development and Final Map, City and Owner desire to provide for the funding of <br /> <br />off-site roadway improvements for the Project in accordance with this <br /> <br />Agreement. <br /> <br />NOW, THEREFORE, <br /> <br />BE IT RESOLVED BY THE COUNCil OF THE CITY OF REDWOOD <br /> <br />CITY, AS FOllOWS: <br /> <br />F: \sha red\Redwood\Cou n ci 1\ <br />Reso-802 <br />FXS:fs <br />01/05/00 <br /> <br />4 <br /> <br />, '" .,,~.. - -...." _.
