<br />3H~~ <br /> <br />WHEREAS, Circle Star and Homestead have requested from Redwood City the <br />right to discharge the sewage emanating from the Service Area in the event of a <br />mechanical and/or electrical failure of the Service Area private facilities or other <br />emergency, into the Redwood City Sanitary Sewage Facilities: <br /> <br />NOW, THEREFORE, Redwood City, Circle Star, and Homestead agree as <br />follows: <br />1. Circle Star and Homestead are authorized to discharge sewerage into the <br />Redwood City Sanitary Sewage Facilities on an emergency basis only in the <br />event of a mechanical and/or electrical emergency at the Service Area or other <br /> <br />unforeseen emergency emanating from the Service Area only. <br /> <br />2. Circle Star and Homestead shall pay Redwood City the total sum of $4,000 as <br />a one-time connection fee for using Redwood City facilities for emergency <br /> <br />purposes. <br /> <br />3. Circle Star and Homestead shall not discharge into the Redwood City Sanitary <br />Sewage Facility (i) any sanitary sewage in excess of an Annualized Daily <br /> <br />Average Flow of 100,000 gallons per day (the "ADAF") and (ii) any sanitary <br />sewage in excess of 165,000 gallons within any twenty-four (24) hour period <br />(the "gpd"). <br /> <br />4. The payment schedule for emergency use shall be based upon the standard <br />Redwood City retail-commercial water rates as follows: Circle Star and <br />Homestead collectively shall pay Redwood City the total sum of $16.11 for <br />each month in which up to 1,000 cubic feet of sewage flow is discharged to <br /> <br />Redwood City facilities. For a month in which sewage flow is in excess of <br />1,000 cubic feet, Circle Star and Homestead shall collectively pay Redwood <br /> <br />City the additional total sum of $3.32 per month for each 100 cubic feet of <br />sewage over the initial 1,000 cubic feet. For any month in which no sewage <br />flow is discharged to Redwood City facilities, no payment is required. The <br /> <br />"'---'----r------"'-'-' ' <br />
