3L-1 REPORT To the Honorable Mayor and City Council From the City Manager March 27, 1999 Subject Redwood Shores Lagoon Access Recommendation Approve resolution authorizing the City Manager to execute Easement and Covenants Agreement ("Agreement") dated February 11, 2000, by and between the City of Redwood City and the Redwood Shores Owners Association. Background Redwood Shores Owners Association ("RSOA") is the owner of a parcel of real property adjacent to Redwood Shores Lagoon, which includes a boat ramp, dock, park and recreational facilities. Through cooperation with RSOA, the City of Redwood City has used the boat ramp for access to Redwood Shores Lagoon for lagoon maintenance purposes for many years, specifically ingress and egress for weed and algae harvesting equipment and small boats used for chemical application and monitoring of water quality. The boat ramp, dock and other facilities located on the property require repair and reconstruction, due to age and deterioration. The RSOA requested that the City provide funding for repair work via the General Improvement District No. 1-64 ("GID 1-64") fund. A negotiation process ensued, with the City seeking assurance that it shall have continuing access to Redwood Shores Lagoon for maintenance purposes, while the RSOA has sought more control of events scheduling and a higher level of aesthetic quality. Under the terms of the Agreement, the City shall provide $160,000.00 from the GID 1-64 fund to RSOA for reconstruction and repair of the boat ramp and related facilities. In return, the City shall acquire an easement for use of the boat ramp for routine and emergency lagoon maintenance purposes, with some restrictions and notification requirements. Additionally, the City shall have certain rights to conduct City sponsored events on the site. The Director of Finance, acting as City Assessor, has determined that the value of the interests to be received by the City under the aforesaid agreement equals or exceeds the costs to be incurred by the City. Alternative Do not authorize execution of the agreement and give further direction to staff. Fiscal Impact Funds are available for the capital improvements (repairs and reconstruction work) in the GID 1-64 fund. The fund is administered pursuant to a development agreement between the City of Redwood City and the developer of the Redwood Shores Area.
