RECITALS A. RSOA is the owner of that certain real property located within City's boundaries, as more particularly described in Exhibit A attached hereto and incorporated herein by this reference ("Property"). The Property is adjacent to the Redwood Shores lagoon ("Lagoon"). The Property is currently improved with, among other things, a small boat ramp ("Boat Ramp") and two docks ("Docks") as more specifically shown in Exhibit B attached hereto and incorporated herein by this reference. B. The Property is part of the Redwood Shores development, and RSOA is subject to, and the Property is encumbered by, the Shores Business Center Association Covenants, Conditions and Restrictions, as more specifically described in Exhibit C attached hereto ("SBCA Restrictions"). The Property is also subject to, among other things, that certain Agreement for Covenants Running with the Land dated April 22, 1996, and recorded April 29, 1996, by and between Richard S.
