<br />~r:..1 <br /> <br />REP <br /> <br /> <br />March 27, 2000 <br /> <br />Subject <br />Agreement for Environmental Regulatory Consulting Services - Redwood Shores Levee <br />Improvements Project - Engineering File No. 904-05 <br /> <br />Recommendation <br />Adopt a resolution approving and authorizing execution of agreement with Huffman & <br />Associates, Inc., of Larkspur, California, for providing wetland and endangered species <br />regulatory consulting services for the Redwood Shores Levee Improvements Project, in <br />an amount not to exceed $75,000. <br /> <br />Background <br />Dr. Huffman, the principal of Huffman & Associates, was called upon, in November <br />1999, to help with various issues that the City Attorney's office was working on relating <br />to the subject project. At that time, the City had received a aO-day "Notice to File Suit" <br />from the Sequoia Audubon Society, and the City Attorney was charting the course of <br />legal procedures which requires the caliber of expertise that Dr. Huffman can provide. <br />Subsequently, Dr. Huffman worked, and continues to work, on the negotiations with the <br />U.S. Fish and Wildlife Service (USFWLS), the Corps of Engineers (COE), and the San <br />Francisco Bay Conservation and Development Commission (BCDC), on permit <br />conditions for the project. Furthermore, Huffman & Associates is currently pursuing <br />permit extensions with COE, BCDC, and the Regional Water Quality Control Board <br />(RWQCB). <br /> <br />Because of the time sensitive nature of the request for Dr. Huffman's services in <br />November, and the uncertainty of the scope of work that Dr. Huffman was to provide, a <br />Purchase Order in the amount of $10,000 was issued to cover his fees. The services <br />that Dr. Huffman has provided thus far, have exceeded this Purchase Order. The scope <br />of services has now become more defined, however, new issues are still surfacing with <br />the advent of the permit expiration, and the construction of the exclusionary fencing. <br />More issues, that would need Dr. Huffman's expertise, are also anticipated, as the <br />negotiations with USFWLS on the sensitive topics of public access and predator <br />management continues. <br /> <br />Because of the unpredictable nature of the scope of services, staff is recommending that <br />the Council authorize the execution of a professional service agreement with Huffman & <br />Associates, in an amount not to exceed $75,000.
