<br />3 Gr-l, <br /> <br />"City" means the City of Redwood City, a municipal corporation of the State <br /> <br />of California. <br /> <br />"City Manager" means the individual designated as the City Manager under <br /> <br />Section 26 of the Charter of the City of Redwood City or his/her designee. <br /> <br />"CouncW means those elected officials which are authorized to exercise the <br /> <br />powers granted to and vested in City under Government Code Section 37100, et <br /> <br />seq., and the Charter of the City of Redwood City. <br /> <br />"Day" means any calendar day, unless a Business Day is specified. For the <br /> <br />purposes hereof, the time in which an act is to be performed shall be computed by <br />excluding the first Day and including the last. <br /> <br />"DirectorY means the Director of Community Development or his/her <br /> <br />designee. <br /> <br />"Fee" means any assessment, license, charge, fee, imposition, tax (but <br /> <br />excluding the telephone users tax), or levy lawfully imposed by any governmental <br /> <br />body. <br /> <br />"Fiber Optic Network Facilities. or II Facilities. means without limitation, any <br /> <br /> <br />and all fiber optic, coaxial and copper cables, conduits, converters, splice boxes, <br /> <br />cabinets, hand-holes, manholes, pedestals, vaults, equipment, drains, surface <br /> <br />location markers, appurtenances and related facilities owned, leased or licensed <br /> <br />by WILLIAMS, located or to be located in the Public Right-of-Way of City and used <br /> <br />or useful for and in connection with the transmission of telecommunication <br /> <br />messages. <br /> <br />R W CICOUDciII Agmy <br />Agmt-341 <br />FXS/fs <br />03/28/00. 03130lOOR <br />
