<br />~ Go ..2 ¡, <br /> <br />, <br /> <br />15. Insurance. <br /> <br />(a) <br /> <br />Any person, firm or corporation WILLIAMS authorizes to work upon <br /> <br />the Public Right-at-Way, including any subcontractor, shat! be deemed to be <br /> <br /> <br />WILLlAMS' agent and shall be subject to all the applicable terms of this <br /> <br />Agreement. <br /> <br />Prior to entry upon the Public Right-of-Way by such agents, <br /> <br />WILLIAMS shall provide City with satisfactory evidence (e.g., in the form of a <br /> <br />Certificate of Insurance) that it and its contractors or other agents who will obtain <br /> <br />access to the Public Right-of-Way pursuant to this Agreement are insured in <br /> <br />accordance with the following, which insurance shall remain in effect throughout <br /> <br />the term of this Agreement and shall be at the sole cost and expense of <br /> <br />WILLIAMS (or its agents). Prior to the start of the work or entry onto the Public <br />Right-of-way, WILLIAMS agrees to procure and maintain and to the extent not <br /> <br />covered by WILLIAMS' insurance, to require its contractor(s) to procure and <br />maintain, at its (or its contractors') sole cost and expense (and to prove to City's <br /> <br />reasonable satisfaction that it remains in effect throughout the work), the kinds of <br /> <br />insurance described below: <br /> <br />(1) <br /> <br />Workers' Comoensatlon and Emolovers' Llabllltv Insurance. <br /> <br />WILLIAMS shall secure the payment of Workers' Compensation in accordance <br />with the provisions of Section 3700 of the California Labor Code (and any <br /> <br />amendments thereto or successor acts or statutes) and WILLIAMS shall furnish <br /> <br />City with a certificate evidencing such coverage together with a verification thereon <br /> <br />as follows: <br /> <br />R W CICoonciII Agmy <br />Agnx-341 <br />FXSIfs <br />03f281OO. 03130lOOR <br />
