It is the intention of this City Council that any bands issued maq be made cailable on terms to be specified in any resolution providing for the form, execution and issuance of bonds, in accordance with the terms of the Mello-Roos Community Facilities Act of 1982. 9. T'he question of the authorization to issue the bonds described herein shall be submitted to the qualified electors within the District for a vote in accordance with the Mello- Roos Community Facilities Act of 1982 and in accordance with the fmdings contained in the Certificate of Developer heretofore filed in these proceedings. - 10. The City Clerk is hereby designated as the official to conduct the special, mailed- ballot election pursuant to Elections Code Sections 307 and 320. 11. The special community facilities district election shall be conducted by mailed ballot. In order to be counted, ballots must be returned to, and be physically received by, the City Clerk before the end of the public hearing on April 24, 2000. If all authorized ballots are received by the City Clerk prior to that time, the City Clerk shall, pursuant to Government Code section 53326(d), immediately close the election and declaze the results. 12. The ballot language is as follows: Shall the City Council of the City of Redvvood City be authorized to issue up to $21,000,000 in one or more series of bonds, levy a special tax and finance public facilities and services by and through its City of Redwood City Community Facilities District No. 2000-1 (Pacific Shores Project), all as specified in its Resolution No.13850 � (Resolution Stating the Necessity to Incur Bonded Indebtedness), and shall the appropriations limit for the District for fiscal year 2000-2001 be established in accordance therewith? -2-
