<br />r¡O-'i <br /> <br />FIRST SUPPLEMENTAL AGREEMENT TO FRANCHISE <br />AGREEMENT FOR SOLID WASTE, RECYCLABLE MATERIALS, <br />AND PLANT MATERIALS COLLECTION SERVICES <br /> <br />THIS <br /> <br />AGREEMENT, <br /> <br />is <br /> <br />made <br /> <br />as <br /> <br />of this <br /> <br />day <br /> <br />of <br /> <br />, 2000, by and between the CITY OF REDWOOD CITY, a <br /> <br />municipal corporation of the State of California ("Agency"), and BFI WASTE <br /> <br />SYSTEMS OF NORTH AMERICA, INC., a Delaware corporation ("Contractor"); <br /> <br />RECITALS: <br /> <br />WHEREAS, Agency and City entered into that certain agreement entitled, <br /> <br />"Franchise Agreement for Solid Waste, Recyclable Materials, and Plant Materials <br /> <br />Collection Services," dated as of September 9, 1999, which agreement became <br /> <br />effective January 1, 2000 (the "Franchise Agreement"); and <br /> <br />WHEREAS, Section 4.04.1 of the Franchise Agreement provides that <br /> <br />Contractor shall collect "Plant Materials" (as defined in the Franchise Agreement) <br /> <br />from residential properties within Agency's geographic limits; and <br /> <br />WHEREAS, Contractor proposes to expand collection of plant materials to <br /> <br />include service to non-residential properties; <br /> <br />NOW, THEREFORE, the parties hereto agree as follows: <br /> <br />1. Amendment. Section 4.04.1 of the Franchise Agreement is hereby <br /> <br />amended to read as follows: <br /> <br />"Section 4.04.1. Plant Materials Collection.
