<br />~ l..J- 1 <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />June 5, 2000 <br /> <br />Subject <br />Advertisement for Bids - ShearwaterlSeacrest Access Path Improvements. <br />Engineering File No. 803-02 <br /> <br />Recommendation <br />Adopt a resolution approving the Contract Documents entitled, "Contract Documents for <br />the ShearwaterlSeacrest Access Path Improvements," and authorize the advertisement <br />for bids. <br /> <br />Background <br />This project is closely related to the mitigation program for the Levee Improvement <br />Project that started in 1997. The improvements are being made to satisfy Federal and <br />State agencies (US Army Corps of Engineers [Corps], Bay Conservation and <br />Development Commission [BCDC], and Regional Water Quality Control Board <br />[RWQCB]), with BCDC being the main focus. <br /> <br />BCDC is an advocate of public access along the shoreline of the San Francisco Bay. <br />Because the levee improvements triggered a review by the Corps and US Fish and <br />Wildlife Service (USFWL) who demanded that some of the bayside exterior levees be <br />closed off from public access, BCBC demanded an alternative inland route to make up <br />for the lost access. Portions of this alternative access that are adjacent to the levee, <br />have been built along with the different levee segments that the City has been building. <br />This project covers the remaining improvements that will complete the alternative public <br />access, as planned. <br /> <br />The improvements mainly include asphalt and decomposed granite pedestrian and <br />bicycle paths. Three public parking lots will also be built as part of this project. <br /> <br />BCDC maintained that these improvements are over due and should have been built <br />prior to the closure of the exterior levee. As of the date of this report, a Stipulated <br />Cease and Desist and Civil Penalty Order is being drafted by BCDC. However, no <br />formal discussion (which is necessary to process the Order) has been held with the City <br />or any of the other permittees. BCDC was clear in their communications with staff, that <br />they would like to see these improvements installed as soon as possible.
