REPORT

To the Honorable Mayor and City Council
From the City Manager

June 12,2000

Subject
Accessory Dwelling Unit Ordinance

Recommendation
Review and discuss alternative regulations goveming accessory dwelling units. Direct staff
to prepare Resolution Initiating Proceedings to Amend the Zoning Ordinance to correspond
to Council's determination.

Background
On April 1 0, 2000, the City Council reviewed the recommended changes to the Accessory
Dwelling Unit Ordinance by the Planning Commission. Those recommended changes *
were:

. Require that the property owner reside in the main unit or second unit.
. Require a conditional use permit and public hearing.
. Allow "tandem" parking in the driveway of the main housing unit to count toward
the required parking for the accessory unit as long as the parking is outside the
required 20 ft. garage setback.

* These recommendations are different than what is now being proposed.

After testimony and discussion the City Council directed staff to investigate the following
issues:

. Re-examine tandem parking in the required front yard for garages (the 20 ft
setback), either covered or uncovered.
. Consider increasing the allowable size of the second unit from 640 sq. ft. to 750 sq.
ft. Also consider the relationship of the second unit as a percentage of the main unit
and as related to the size of the lot.
. Require that the property owner occupy the property (either in the main or second
unit) via a deed restriction or other acceptable legal mechanism while allowing
exceptions to this requirement if there are any hardships.
. Notify surrounding owners of the proposed second unit either through a Conditional
Use Permit or a "non-discretionary" permit similar to newly adopted process for
large family day care homes.
. Investigate the density and concentration of second units per block/neighborhood,
taking into consideration parking supply.
. Examine issues of legalizing some of the approximately 2,000 illegal units through
an amnesty program.

Presented below are the planning issues, various options, and general impacts of these
changes. The City will deal with illegal garage conversions for additional living space on
a case by case basis as they come to our attention.
