..

June 12, 2000

Subject
Acceptance of Deeds
East Bayshore Road Realignment - Lands of Cargill, Incorporated
Engineering File No. 806-04

Recommendation
Accept two Deeds of Property from Cargill, Incorporated (Cargill), for the East Bayshore
Road Realignment; one for a land transfer for road purposes, and one for a temporary
easement for roadway construction.

Background
The deeds are being offered by Cargill, (Grantees) over a portion of their property
bounded by Seaport Boulevard and the present East Bayshore Road, as shown on the
attached Exhibit "A". This property is required in order for the City to construct a
portion of the new alignment for East Bayshore Road, which will be relocated to
connect to Blomquist Street.

The realignment project has been in process for several years, and the City has been
in support of trying to get this work constructed. We have obtained the necessary
Corps of Engineer's permit and the environmental clearance for the project. Funding
has always been lagging.

With the application for annexing and subdividing the Pacific Shores Commercial
project, the conditions of approval were placed on the developer to install this
improvement. Plans are now being prepared for this work, and the design requires an
encroachment onto a small portion of the Lands of Cargill, Incorporated. Cargill has
graciously offered to deed this portion of the property to City, in order for the
improvements to be constructed.

The area of the piece of land being offered is only 0.44 acres, compared to Cargill's
holdings of well over 1,260 acres. The deed will provide the additional land needed for
the realignment to occur at the Blomquist Street Intersection as planned. The
temporary construction easement is required in order to place surcharge fills where the
old wetlands are being filled in for the new roadway. The surcharged fill will be
removed upon completion of construction.

Fiscal 1m pacts
Following Council Approval, the deed will be recorded with the County Recorder.
There are no fiscal impacts involved wit this deed.

ù

0 Patterson
anager, Engineering & Construction

Ed Everett
City Manager

JP/JKL:ss
SlIibrary/reportslE Bayshore Deed

._~.....
