Commi!§jon of State <br />Mandates, No. SCV-221243 ' ' <br /> <br />Dear Councilmembers: <br /> <br />The above-named case relates to the Educational Revenue Augmentation <br />Fund (.ERAF"), which was established by the State Legislature to divert a portion <br />of the property taxes levied by local public agencies to provide financing for <br />school programs. According to information furnished by the League of California <br />Cities Legal Advocacy Committee, since its inception. the ERAF diversion has <br />amounted to more than $25 biNion. The annual cost to California cities in 1999 <br />amounted to S548 million. <br /> <br />The 'case was brought by counties to obtain a legal determination that the <br />ERAF shift is reimbursable under the California Constitution (Cal. Canst. Art. <br />138, § 6 rProposition 4" of 1979]). The. trial,court held that the shift is a <br />reimbursable mandate because it compelled'iocal agencies to fund a previously <br />state-funded program. Background information from the Committee is included <br />with this letter. ' , <br /> <br />Amicus participation would be without 'cost to the City.
