<br />T) M -S- <br /> <br />Hold Harmless Agreement <br /> <br />1. <br /> <br />Members of a PO shall not be deemed to be employees or agents of the <br />other PDs by virtue of their participation, pursuant to this MOU. <br /> <br />2. <br /> <br />Each PO (the Releasing PO) waives and releases the other POs from any <br />and all claims, suits, liabilities and damages for personal injuries, property <br />damage, workman's compensation, or any other claims, loss, or damage <br />asserted or made by the Releasing PO's personnel, its heirs, executors, <br />administrators, beneficiaries, or assigns as a result of Releasing PO's <br />personnel's participation under this MOU. Each PO assumes any and all <br />risks associated with, or that relate to, its members' participation under this <br />MOU. <br /> <br />3. <br /> <br />Each PD hereby agrees to hold harmless, defend, and indemnify the other <br />POs, their respective officers, agents and/or employees from any and all <br />damages and claims that arise as a result of the intentional tortious acts or <br />sole negligence of its personnel participating under this MOU. <br /> <br />James R.
