<br />'tß-,) <br /> <br />to use for repayment of the above <br />mentioned reimbursement and will comply <br />with all conditions of each option as <br />follows: <br /> <br />(a)Option 1: CITY may pay, in a lump sum <br />payment, their entire share of <br />reimbursement to COUNTY. Payment will be <br />due on or before October 1, 2000. <br /> <br />(b) Option 2: CITY may pay one- <br />third(1/3rd) of their share of <br />reimbursement (principle) plus respective <br />interest to COqNTY over the three year <br />period of this contract. Interest will <br />be calculated on the total CITY share for <br />Hayden/Vincent Bill Reimbursement for FY <br />99-00 which equals $593,439.00 The <br />interest will be based on the Local <br />Agency Investment Fund Rate (LAIF Rate). <br />The LAIF Rate, as published as of July 1 <br />of each contract year, will be used to <br />determine the interested owed by CITY for <br />each of the three years for which <br />repayment may be spread over. The first <br />of three payments will be due on or <br />before October 1, 2000. The second of <br />three payments will be due on or before <br />October 1, 2001. The thi rd of three <br />payments will be due on or before October <br />1, 2002. <br /> <br />6. <br /> <br />Defense of Dangerous Animal Dete~inations. The parties <br />acknowledge that CITY is and will remain solely <br />responsible for arranging and conducting hearings under <br />its. Dangerous Animal Ordinances, including but not <br />limited to providing hearing officers and a location for <br />the hearings. However, the parties agree that, at CITY's <br />option and for its convenience, CITY may utilize COUNTY <br />offices and/or the services of the COUNTY contract <br />hearing officers for purposes of conducting Dangerous <br />Animal Hearings under the provisions of CITY's Dangerous <br />Animal Ordinance. The parties recognize that the costs <br />of these hearings are ordinarily borne by the animal <br />owner. However, in the event CITY and/or COUNTY are <br />unable to collect these costs from the owner within a <br />reasonable time, CITY shall be responsible for these <br />costs. <br /> <br />4 <br /> <br />..- 1r <br />
