. <br /> � <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> July 10, 2000 <br /> Subject <br /> Seaport Centre Maintenance District — District Confirmation and Levying of <br /> Assessments — Engineering File No. 807-05 <br /> Recommendation <br /> 1. Conduct a public hearing, declare ballot results <br /> 2. Confirm the Revised City Manager's and Revised Engineer's Reports <br /> 3. Adopt a resolution to order the levying of assessments in accordance with the <br /> City Manager's and Engineer's Reports. <br /> Background <br /> This Maintenance District was formed on April 22, 1985, to provide a source of revenue <br /> for the maintenance and operation of certain storm water and sanitary sewer systems, <br /> and the perimeter levees at Seaport Centre. Since then, annual or bi-annuaf public <br /> hearings have been held to receive input from affected property owners, and to approve <br /> the budget and assessment. <br /> On May 22 2000, the City Council approved the Manager's and Engineer's Reports, <br /> and adopted a Resolution of Intention No. 13904, which ordered the levying of <br /> assessments for FY 2000-2001 through 2004-2005. The reports also provide budgets <br /> for each of the five years under consideration, and the Resolution provides for the <br /> maximum annual assessment for the period. The Council's action set in motion the <br /> process of calling for a"property owner's election" on the assessments by notifying the <br /> owners of a"notice of election and public hearing". In accordance with the above <br /> Resolution, election notices and ballots were mailed out to the affected property <br /> owners, as required by Proposition No. 218. <br /> The public hearing that will be conducted today will allow concerned parties to speak for <br /> or against the action. Qualified voters will be allowed to change their vote during this <br /> public hearing. A final tally of votes will be reported at the conclusion of the public <br /> hearing. Action may be taken by the Council to adopt the Resolution as recommended, <br /> or to modify the reports including the assessment distribution formulas, and ask the <br /> property owners to revote. <br /> ._.._.. ___ _,._.. � _ <br />
