<br /> Section 2.
<br /> a) The Pipeline shall be constructed, operated, mmntmneci, repmred, renewed modified �d/or reconstructed by
<br /> the licensee in strict cor�formity with LTnion Pacific Amlroad Co. Common St�d�d Specification 1029 adopted November
<br /> 1949. �d all �ner�dme�s thereof �d supplementa thereto, which by this referersce ia heraby made a p�t hereof, e�cept
<br /> � maY be modifi�i �d approved by the Licensor's Vice President-F.ngineering Senrices. In the event such Specification
<br /> ro�$ ��Y �P�'t �� � neq�+emeirts of �y federal, state or muaicipal lcw cr regulction such requirements shall
<br /> govern on all po' of conflict but in all other respects the Specification shall apply,
<br /> b) All work perforir�ed on ProPert}' of the lioensor in conriection wlth the cor�struction, mmnten��ce, repmr, renewcl,
<br /> modification or reconstruction of ths Pipeline shall be done to the satisfaction of the licensor.
<br /> c) Prior to the commencement of �y worr in coru�ection with the cor�tructiorL mmnter�ce, reperir, renewal,
<br /> modification, relocation, reconstruction or removal of the Pipeline where it pasaes underneath the roadbed �sd tracic or
<br /> �acl� of the Licensor, the Licensee shall submit to the Licensor pl�a setting out the method �d m�ner of h�dling the
<br /> work ir�cludir�g the shoring �d cribbin9, if �y , required to protect the licensor's operations. �sd shall not proceed with
<br /> the wurk �til such p1�s haee been appro�ed by the Vioe presider�t-Engit�eering $aMCes of the Licensor �d then the work
<br /> shall be done 10 the satisf�cti�on of the Vice President-Engir�eering Services or his authorized representativ�e. The Licensor
<br /> shall have the right if it �o elects, to provide such support as it may deem neceas�y tor the safety of ib track or traclrs
<br /> diu�ing the time of construction, mmnten�yce, repmr, renewcl, aiodifi�ction, ���o�, �onstruction or removal of the
<br /> PiPeline, �d, in the eMer�t the Licenaor provi�des such support, the Licensee shall pay to the licensor, within fifteen (15) days
<br /> c�ter b�11s shcll have been rer�dered thersfor, all ezpense incurred by the Licensor in conr�ection therewitl'L which e:pense
<br /> shall include all assignable co�fs.
<br /> d) The licensee ahall keep �d mmntmn the soil over the Pipeline thoroughly compacted m1d the grade ev�en with
<br /> the adjacent surface of the grouad.
<br /> Section 3.
<br /> If � emergancy should �ise requiring immediate cttenhon, the licer�ee shall pravide as much notice aa
<br /> practical�e to lioensor betore oomrnerring �y vvork. In all other situadions. the Licensee shall notify the Licensor at lecst
<br /> ten (10) days (or such other time as the licsnsor may c11ow) in adv�ce of the commer�cement of �}r work upon property
<br /> of the Licensor in connecti�on vvith the constru�ction, mmnten�yce, repmr, rer►ewal, modification, reconstruction. relocation
<br /> or removal of the Pipeline. All such wor1� shall be prosecuted diligentt}► to completion.
<br /> Section 4. LT�,�T1g� Tp gEaR �r*�nF �sr��TcF
<br /> The licerssee shall be� the entire cost cmd ezper�e incw�red in connection with the cor�truction, mmnten�ice,
<br /> rePm�' �i I'etiewal �d m�y► �d all modificatior�, revision, relxation, removal or reconstru�ction of the Pipeline, including
<br /> �sY �d cll ezpense which may be incurred by the Licensor in conr�ection therewith for supervision, inspection, flagging,
<br /> or otherwise.
