<br /> <br />-I <br /> <br />July 24, 2000 <br /> <br />Subject <br />1999-2000 Cost Shared Sidewalk Repair Project <br /> <br />Recommendation <br />By Motion, approve change order number three in the amount of $23,000.00, accept the <br />improvements, and release the retention for the 1999-2000 Cost Shared Sidewalk Repair <br />Project to P & P Construction, Inc. of Newark, CA. <br /> <br />Background <br />On June 14, 1999 the City Council approved the contract documents and specifications <br />and authorized the City Clerk to call for bids for the subject contract. Six sealed bids were <br />received and opened at the Office of the City Clerk on July 7, 1999. P & P Construction, <br />Inc. was the lowest responsible bidder at $127,750.00, 3,37% below the Engineer's <br />estimate, The contract work proceeded along and staff completed <br /> <br />On May 8, 2000, the Council approved change order number two in the amount of <br />$23,842.00 for additional sidewalk repairs completed under cost shared agreements. At <br />the time of acceptance of Change Order Number 2, the sidewalk repair work was <br />substantially completed and Council was advised there were outstanding claims for <br />additional work of up to $25,000,00, <br /> <br />Change order number three covers the additional work including extra-ordinary excavation <br />for tree preservation work, additional hand excavation around shallow underground street <br />light conduit, additional excavation to replace failed subbase areas, and additional <br />excavation in the street area to allow for the re-Iocation of the curb further away from trees, <br /> <br />The contractor's final claim submittal was $38,000, where the City was prepared to <br />approve $15,100, The final amount of the change order is $23,000,00 the amount staff <br />was able to verify as completed work, <br /> <br />Alternatives <br />1) The Council could not approve the change order nor accept the project. This would <br />result in probable claim pursuit by the contractor and most likely arbitration or court <br />resolution, <br /> <br />.-. -, . '-P 'T <br />
