This Council hereby finds and determines that sanitary sewerage treatment capacity rights allocated to the City of Redwood City by the South Bayside System Authority, owner of the sanitary sewerage treatment plant which provides treatment service for sewage emanating from the City and the Emerald Lake Heights Sewer Maintenance District, shall be the source of treatment capacity for sewage emanating from the Annexing Territory, and treatment capacity rights allocated to the County of San Mateo pursuant to the Capacity Agreement shall not be the source of treatment capacity for the Annexing Territory. 3. The Annexing Territory is all that certain real property located in the County of San Mateo, State of California, more particularly described as follows: Lot 9, Block 205 and a portion of Eastview Way as said Lot, Block and Way are shown on the map entitled "Estates of Emerald Lake, Subdivision Two", filed in the Office of the County Recorder of San Mateo County, State of California on August 1, 1927 in Book 16 of Maps at pages 18-21 and more particularly described as follows: Beginning at the south westerly corner of said Lot 9, said point also being an angle point in the Emerald Lake Height Sewer Maintenance District as established by Resolution No. 46942 passed and adopted on June 4, 1985; Thence from said Point of Beginning, North 2°53'20" West along the westerly line of said Lot and continuing along said district boundaries 158.99 feet to a point in the southerly line of said southerly line of said Eastview Way; Thence leaving said westerly line and continuing northwesterly along said southerly line and district boundary, 154.11 feet to an angle point in said district boundary, said point also being the northwesterly corner of Lot 11, Block 205 as shown on said map; Thence leaving said southerly line and district boundary, northeasterly, in a direct Reso-951 3 DES:djk F:/Shared/Redwood/Council/Reso 07/25/00 ___..._ ._..._ . _._ r _
