IOA-i ��O <br /> some other way. <br /> (g) RCN aboveground equipment shail be painted dark green. <br /> (h) No earlier than five (5) years from the, Effective Date, RCN shall retrofit <br /> aboveground enclosures flush to grade at such time as the equipment and <br /> methodology used by RCN in areas similar to Redwood City has proven to be <br /> more desirable. City shall have the right to require RCN to replace equipment <br /> located in the vaults with more technologically advanced equipment. <br /> 4. Comaliance with Standards. <br /> (a) RCN agrees to keep said Fiber Optic Network Facilities in good and safe <br /> condition and free from any nuisance, to the reasonable satisfaction of City's <br /> Director. <br /> (b) RCN shall construct, install, operate and maintain all Fiber Optic <br /> Network Facilities in accordance and in conformity with all applicable City, State, <br /> Federal and regulatory agency Laws, ordinances, rules and regulations. <br /> 5. Service Chanqe. RCN provides Telecommunications Services in <br /> California pursuant to all Laws, including federal law and its Certificates of Public <br /> Convenience and Necessity received from the PUC. The type of service RCN <br /> offers to its customers through the Fiber Optic Network Facilities in Public Right-of- <br /> Way consists of business and residential Telecommunications Services which are <br /> presently permitted by Law. If the nature or character of RCN's service changes to <br /> include additional or alternative services, including but not limited to, community <br /> Agmt-374 <br /> Sh/RWGCouncil - 9 - <br /> FXS/fs <br /> 08/02/00 <br />
