1 �A-� �y <br /> Finding: The City Council finds that there will be significant positive impact in the City <br /> in having, for the first time, competitive options available to its residents in the <br /> selection of video programming, local and long distance telephone service, and high- <br /> speed Intemet access services. The City believes that competition will result in lower <br /> rates and improved quality of service. <br /> 2. Whether there will be an unreasonable adverse economic or aesthetic impact <br /> upon public or private property within the area. <br /> Finding: The City finds that adding a second cable system would have minor adverse <br /> aesthetic impact, in terms of additional cables on the utility poles and some additional <br /> above ground equipment in underground utility areas. The City finds, however, that <br /> these would be oufinreighed greatly by the positive effects of competition. <br /> 3. Whether there will be an unreasonable disruption or inconvenience to existing <br /> users, or any adverse effect on future use, of utility poles, public easements, <br /> and the public rights-of-way. <br /> Finding: The City finds that there will not be any unreasonable disruption or <br /> inconvenience, other than temporary effects of construction of the new system. It is <br /> expected that all requirements of the Public Utilities Code and the Municipal Code will <br /> be adhered to. <br /> 4. Whether the franchise applicant has the technical and financial ability to <br /> perform. <br /> Finding: The City finds that RCN Telecom Service of California, Inc. has the <br /> requisite capability to construct and operate the proposed cable system. <br /> 5. Whether there is any impact on the City's interest in having universal cable <br /> service. <br /> Finding: The City finds no impact, since the incumbent cable operator already <br /> provides universal cable service, and the applicant, RCN, will be required to do the <br /> same. <br /> 6. Whether other societal interests generally considered by franchising authorities <br /> will be.met. <br /> Finding: The franchise grant to RCN will meet all societal interests that the incumbent <br /> cable operator now meets and is expected to meet in any new franchise term. In <br /> addition, the benefits of completion will be realized. <br /> 7. Whether the operation of an additional cable system in the community is <br /> economically feasible. <br /> Finding: Since competitive franchises are now a fact of life in many communities, and <br /> more regularly are being granted, the City finds that a second cable system is <br /> economically feasible at this time. <br /> 8. Such other additional matters, both procedural and substantive, as the <br /> franchising authority may determine to be relevant. <br /> Finding: The City finds that all known relevant factors have been considered, and that <br /> the proposed franchise agreement with RCN incorporates requirements considered <br /> 4 <br /> � <br />
